This Privacy Policy explains how Appilates collects, uses, stores, and discloses personal information when you use our platform, website, or mobile applications (together, “the App”), whether as an End User accessing sessions or as a Studio creating them.

By accessing or using the App, you agree to the terms of this Privacy Policy and our applicable Terms of Use.

2. Scope and Application

This Privacy Policy applies to:

  • End Users – individuals who register or access sessions created by a Studio through the App; and
  • Studios – businesses or instructors who register accounts to create, manage, or share sessions with End Users.

It also covers any visitors to our website and anyone who contacts us.

3. Information We Collect

3.1 Information you provide directly

We collect personal information when you:

  • create or manage an account (End User or Studio);
  • participate in or create sessions;
  • communicate with us or with each other via the App;
  • complete forms, feedback, or response fields;
  • subscribe to marketing or updates; or
  • contact support.

This may include:

  • name, email address, phone number, and account credentials;
  • billing and payment information (for Studios);
  • health-related or injury information voluntarily shared with a Studio (End Users);
  • session data, photos, videos, or comments you upload;
  • support or feedback messages.

3.2 Information collected automatically

When you use the App or Website, we automatically collect:

  • device and browser information;
  • IP address and location;
  • usage data such as log-ins, pages viewed, and session length; and
  • crash logs and diagnostic information to maintain service stability.

3.3 Information from third parties

We may receive information about you from:

  • Studios or End Users interacting with you via the App;
  • our service providers (e.g. analytics, payment, or cloud hosting partners);
  • publicly available sources or social integrations (if enabled).

4. How We Use Your Information

We use personal information to:

  1. operate, maintain, and improve the App and related services;
  2. create and manage your account;
  3. provide and support sessions between Studios and End Users;
  4. communicate with you (including service announcements and updates);
  5. personalise your experience and recommend relevant content;
  6. enforce our Terms of Use and comply with legal obligations; and
  7. produce aggregated analytics to enhance performance and product development.

We may also create anonymised or aggregated data that no longer identifies you. We own all rights to such data and may use it for research, analytics, and business insights.

5. Disclosure of Your Information

We may disclose personal information:

  • to Studios, when End Users join or interact with a session;
  • to End Users, when Studios share contact or session details (e.g. dispute resolution);
  • to our service providers (cloud, analytics, payment, email, IT support);
  • to law-enforcement agencies or regulators if required by law;
  • to purchasers or investors in connection with a business sale or restructuring; and
  • to any person with your consent.

We require all third parties who process personal data on our behalf to comply with privacy and security standards equivalent to those set out in this policy.

6. Data Ownership

  • End Users retain ownership of their User Data.
  • Studios retain ownership of their Studio Content and Sessions.
  • Appilates Limited holds licences to use, process, and aggregate this data solely as necessary to provide, maintain, and improve the App and comply with applicable law.

7. International Transfers

Appilates is based in New Zealand. Personal information may be stored on servers located in New Zealand or other countries with comparable privacy protections.
Where data is transferred internationally, we ensure that appropriate safeguards (such as contractual clauses or equivalent legal mechanisms) are in place.

8. Data Retention

We retain personal information only as long as reasonably required:

  • to provide the App and related services;
  • to meet legal, tax, or accounting obligations; and
  • to resolve disputes or enforce agreements.

Anonymous or aggregated data may be retained indefinitely.

9. Your Rights

Under the New Zealand Privacy Act 2020, you have the right to:

  • request access to and correction of your personal information;
  • withdraw consent for certain uses;
  • request deletion of your account; and
  • lodge a complaint with the Office of the Privacy Commissioner (www.privacy.org.nz).

11. Studios’ Privacy Responsibilities

Studios are independent data controllers of any information they collect directly from End Users (e.g. forms, questionnaires, or feedback).
Studios must:

  • comply with the Privacy Act 2020 and all applicable Data Privacy Laws;
  • maintain their own privacy policy; and
  • obtain valid consent from End Users before collecting, using, or disclosing personal information.

Appilates is not responsible for how a Studio uses End User information collected directly by that Studio.

12. Children and Minors

The App is not intended for children under 16 without parental or guardian consent. If we learn that a child’s personal information has been collected without appropriate consent, we will delete it promptly.

13. Third-Party Links

The App may contain links to third-party websites or resources. Appilates is not responsible for the content or privacy practices of those external sites. You access them at your own risk.

14. Updates to This Policy

We may update this Privacy Policy periodically.
Updates will be posted on our Website and/or within the App, with the “Last Updated” date adjusted accordingly.
Continued use of the App after changes take effect indicates acceptance of the revised policy.
